Big news on the Day One right to claim unfair dismissal

As we’ve reported before, the original Employment Rights Bill included a measure to make unfair dismissal a right from the first day of a new job.

However, the Government has changed its mind and amended the Bill so that employees will need to have been employed for six months before they can make an unfair dismissal claim.

The compromise was reached after discussion with business representatives, including the CBI, in order to get the Bill through its House of Lords stages. However, it’s also thought the Government will attempt to remove the current cap on unfair dismissal payments.

The measure is expected to come in on 1 January 2027, meaning that employees who begin jobs from July 2026 will be covered.
